Finicum could have peacefully surrendered when Payne did.

Watching the video I'm almost wondering if he was shot (the cops were shooting the vehicle) and he was putting his hand on his side while trying to maintain his balance. Both hands go up and down, but only one looks like it was on his side. It doesn't look like a reach, if you blow it up and slow the frame rate down I didn't see him actually reach into a pocket but hold his side.

Hard to imagine that if he wanted to go down guns blazing, that he would walk out into the open, stand with his back facing a guy with a gun and attempt to draw on a cop already aiming at him.
I'm pretty sure he would have jumped into the snow bank and opened fire on whomever he could take out.

I thought he may have been hit in the side too and was holding himself when he was looking around.
They were on their way to a meeting to talk about the constitution and a corrupt government that won't obey it and avoids the mention of it like poison. They were led to believe the Grant county Sheriff was a constitutional sheriff and probably thought he would help them.
They were ambushed, Lavoy Finicum killed and the rest will be silenced in prison. The corrupt murderous politicians and their lackeys can get back to their corruption now and continue to fill their pockets with money and driving the rest of the ranchers off the land. No more talk about the constitution.
