The fence itself does not establish ownership (aka 'title'). The fence establishes possession. The two concepts are related but not the same thing. The treaty with Mexico establishes the boundary where title starts or ends. Any fence establishes where possession starts or end. The highest title is where possession and ownership coincide in the same property but the two concepts might be separated by many years and eventually come back together.
