    Pennsylvania Gov. Tom Wolf’s executive orders to close “non-life-sustaining” business and place restrictions on public gatherings to mitigate the spread of the novel coronavirus were declared unconstitutional by a federal district judge in Pittsburgh on Monday, who said they violated both the First and 14th Amendments.

    U.S. District Judge William Stickman IV, 41, who was appointed to the bench by President Donald Trump in 2019, ruled in favor of hair salons, drive-in movie theaters, a farmer’s market vendor, a horse trainer, four western counties and several Republican officeholders.

    In a 66-page ruling, Stickman said he “believes that defendants undertook their actions in a well-intentioned effort to protect Pennsylvanians from the virus. However, good intentions toward a laudable end are not alone enough to uphold governmental action against a constitutional challenge. Indeed, the greatest threats to our system of constitutional liberties may arise when the ends are laudable, and the intent is good — especially in a time of emergency.”

    “Even a vigilant public may let down its guard over its constitutional liberties only to find that liberties, once relinquished, are hard to recoup and that restrictions — while expedient in the face of an emergency situation — may persist long after immediate danger has passed.”

    The ruling seems at odds with two rulings earlier this year by the U.S. Supreme Court which sided with governments in California, Illinois and Nevada on limiting gatherings, but those were more specific with regards to religious liberty. In both of the cases, the court was divided sharply 5-4 with Chief Justice John Roberts writing that courts must give elected officials wide latitude to make health and safety judgments during a pandemic.

    Both drew stinging rebukes from Justices Sam Alito, Clarence Thomas, Brett Kavanaugh and Neil Gorsuch.

    "The liberties protected by the Constitution are not fair-weather freedoms — in place when times are good but able to be cast aside in times of trouble," Stickman wrote. "There is no question that this country has faced, and will face, emergencies of every sort. But the solution to a national crisis can never be permitted to supersede the commitment to individual liberty that stands as the foundation of the American experiment. The Constitution cannot accept the concept of a 'new normal' where the basic liberties of the people can be subordinated to open-ended emergency mitigation measures.

    "Rather, the Constitution sets certain lines that may not be crossed, even in an emergency. Actions taken by defendants crossed those lines. It is the duty of the court to declare those actions unconstitutional."

    Vaccine is a mental construct. No cow will ever be involved in a treatment for a mental construct calling itself "COVID19". However the insessent carping on the topic of a cure for a creation of the mind will create the circumstances where a vaccine of distilled water will be most effective.     Texas GOP Urges Abbott to ‘Open Texas Now’

    That’s the call to action of a resolution passed nearly unanimously by the Republican Party of Texas executive committee, urging Gov. Greg Abbott to “immediately rescind all COVID-related mandates, closures, and restrictions” and reopen the state.

    Consisting of one man and one woman from each of the state’s 31 senate districts, the SREC is, essentially, the governing body of the Republican Party of Texas, meeting several times a year to do the party’s business, such as organizing convention and passing resolutions.

    Rolando Garcia, the newly elected committeeman for Senate District 15 in Houston who authored the “Open Texas Now” resolution, says he was motivated by Abbott’s announcement last week, which allowed some businesses to open at 75 percent capacity while others were forced to remain closed.

    “[Abbott’s] announcement last week about another incremental increase in capacity was the last straw. It is so blindingly obvious to everyone that the lockdowns and restrictions were a mistake and devastated the lives of so many people,” Garcia told Texas Scorecard.

    “I really hoped that last week’s announcement would finally put an end to this madness. Instead, we just got more games about 50 or 75 percent capacity … for some businesses … in some regions. It’s such a farce at this point and totally disconnected from scientific or public health considerations. It was clear that the state party had to take a stand, so I authored and submitted that resolution.”

    The resolution passed overwhelmingly during the committee’s meeting in Houston this past weekend, with 54 members in favor and just four voting against.

    “If we were voting based on what we hear from the grassroots, it would’ve passed with every single vote,” Garcia added.

    Garcia also stressed that the goal of the resolution was not to “punish” Abbott, but rather to urge a swift course correction.

    “For a state party to publicly disagree with a sitting governor of the same party is not something any of us take lightly, and the instinct of loyalty to leadership is usually pretty strong among party activists. So for this to happen underscores the depth of the anger and frustration out there,” said Garcia.

    The full resolution, as passed by the State Republican Executive Committee, reads as follows:

    “Whereas, Texans have been under emergency closures, lockdowns, mandates, and restrictions for SIX MONTHS;



    “Whereas, state and local governments have exercised egregious overreach in misguided attempts to mitigate the spread of the COVID-19 disease;



    “Whereas, state and local government overreach has infringed on our Constitutional liberties – including our rights to property and to peaceably assemble;



    “Whereas, this egregious government overreach has resulted in unthinkable depredations upon the people of Texas, including left millions unemployed, countless businesses bankrupt or on the verge of bankruptcy, nursing home residents dying alone and isolated, lives ruined and dreams destroyed;



    “Whereas, COVID-19 can pose a serious risk, in particular to some at-risk groups, and requires Texans to act responsibly for the health of themselves and their loved ones;



    “Whereas, businesses and customers are fully capable of operating freely while undertaking reasonable precautions without top-down, government mandates;



    “Whereas, every day that closures and restrictions continue, they wreak havoc on the livelihoods and liberties of Texans,



    “Therefore be it resolved, the Republican Party of Texas calls on Gov. Greg Abbott to immediately rescind all COVID-related mandates, closures, and restrictions and to open Texas NOW. A copy of this resolution shall be sent by the Republican Party of Texas to the Governor, Lt. Governor, Attorney General, Republican State Senators, and Republican State Representatives.”

    Growing Research Indicates Many COVID-19 Cases Might Not be Infectious at All

    Elevated ‘cycle thresholds’ may be detecting virus long after it is past the point of infection.

    A growing body of research suggests that a significant number of confirmed COVID-19 infections in the U.S. — perhaps as many as 9 out of every 10 — may not be infectious at all, with much of the country’s testing equipment possibly picking up mere fragments of the disease rather than full-blown infections.

    Confirmed cases of the disease have been the focal point of public health authorities and governments worldwide for many months, with countries across the globe working frantically to shore up their testing infrastructure and ensure that most citizens who want a COVID-19 test can obtain one with relative ease.

    Many politicians, meanwhile — including most state governors in the U.S. — have tied reopening policies to the number of cases detected in the local community, with regions and localities often being permitted to reopen in staggered “phases” only when they have reached successively lower benchmarks of average new daily cases in the area.

    Numerous institutions, meanwhile, have adopted testing protocols in an attempt to preempt the spread of the virus. American colleges and universities, for instance, have turned to mass testing in order to closely monitor incidences of the disease among students, particularly residential students living on campus.

    Yet a burgeoning line of scientific inquiry suggests that many confirmed infections of COVID-19 may actually be just residual traces of the virus itself, a contention that — if true — may suggest both that current high levels of positive viruses are clinically insignificant and that the mitigation measures used to suppress them may be excessive.

    ‘Cycle threshold’ set very high for many tests

    At issue is the method by which many COVID-19 tests detect a patient’s viral load within a given sample. Polymerase chain reaction tests, which have been widely deployed to determine if individuals are infected with the disease, function by amplifying DNA samples to the point that an antigen can be detected and classified.

    The “cycle threshold” is the number of amplification cycles a PCR test goes through before a target pathogen is detected. A lower cycle threshold means that a higher amount of the virus was present in the sample; a higher threshold means the machine had to work harder to detect the virus in the sample, indicating a lower viral load and more likely a non-infectious patient.

    According to a rundown of PCR tests compiled by the Foundation for Innovative New Diagnostics, many manufacturers of PCR tests set the cycle threshold cutoff for a positive sample at up to around 40 cycles, a level numerous public health officials believe is guaranteed to return what are effectively false positive results that have detected fragments of the virus.

    “I’m shocked that people would think that 40 could represent a positive,” Juliet Morrison, a virology professor at the University of California, Riverside, told the New York Times in August.

    Health authorities elsewhere have indicated similar skepticism of high-threshold tests. A spokeswoman for Taiwan’s Central Epidemic Command Center said in June that the agency only assigns positive cases to samples with Cts of 35 or less, with authorities there believing that any samples with Cts of more than 32 are likely (though not definitely) non-infectious.

    A team of researchers at Oxford, meanwhile, wrote in a preprint paper last week that, based on a review of various sample collections, swabs requiring more than 30 cycles were “associated with non-infectious samples.”

    Binary positive-negative test results — in which cycle thresholds are not considered — will “result in false positives with segregation of large numbers of people who are no longer infectious and hence not a threat to public health,” they wrote.

    Preprint papers have not yet been through the peer review process, so their results and conclusions can be changed prior to full publication. Yet several other research projects have indicated similar results. One, published in April by public health authorities out of France, found that “patients with Ct values equal or above 34 do not excrete infectious viral particles.”

    Similarly, a study out of Ireland seeking to determine “the duration of infectivity” of COVID-19 patients found that, of numerous samples subject to PCR testing, scientists were unable to achieve positive culture growth in any that required more than 34.3 cycles.

    Both of those thresholds are notably smaller than the maximum number of cycles instituted by many test manufacturers, suggesting that there may be many nominally positive COVID-19 cases that are innocuous far as infectiousness and illness are concerned.

    Echoing those concerns, researchers at Harvard in May argued that “the Ct value from positive test results, when interpreted in context, can help to refine clinical decision making,” and that a cycle threshold of around 34 may be a useful tool for determining when a patient is truly infectious and when he or she is merely carrying remnants of the virus.

    Such a policy, if implemented, could have momentous implications for public health policy in the U.S. and elsewhere. Presently, in many industries and at many institutions, a single positive COVID-19 case can result in a complete shutdown of the affected company or university or elementary school, followed by a rush to have everyone tested out of concern that the virus may have spread.

    A greater emphasis on the cycle threshold of positive tests may preempt such disruptive policies by signaling which positive test results are truly infectious and which are detecting low viral loads at much less threat of infectivity.

    Early indications suggest the number of clinically trivial positive cases in the U.S. might be startlingly high. The New York Times said last month that a review of the cycle thresholds of positive cases in Nevada, New York and Massachusetts indicated that “up to 90 percent of people testing positive carried barely any virus.”

    Those numbers, if extrapolated nationwide, could suggest that a significant proportion of the mitigation and preparation measures currently in place across the U.S. might be excessive relative to the actual level of infectious cases around the country.

    Ultimately it can be difficult to determine the cycle thresholds used at laboratories across the country, making that kind of extrapolation difficult. A spokeswoman for LabCorp — one of the largest clinical laboratory groups in the world — said the company “does not include the CT value in result reporting.”

    “Our CT cutoff is based on extensive validation,” she said, “and is within the accepted range to accurately identify individuals currently infected with SARS-CoV-2.” The company on its website says it has performed 13.5 million COVID-19 tests, about 15% of the country’s total number of tests.

    At the Center for Evidence-Based Medicine at Oxford University, researchers stressed last month that “PCR detection of viruses is helpful so long as its limitations are understood; while it detects RNA in minute quantities, caution needs to be applied to the results as it often does not detect infectious virus.”

    “If this is not understood, PCR results may lead to restrictions for large groups of people who do not present an infection risk,” they wrote.

In addition to these established infections, new infectious diseases periodically emerge. In extreme cases they may cause pandemics such as COVID-19; in other cases, dead-end infections or smaller epidemics result.     President Trump should take actions to turn our economy around and try with all his might and highest intentions to save America. He must rescind the Declaration of an Emergency NOW and tell the governors to halt the lockdowns NOW.

    A harsh critic of the federal government's response to the coronavirus has been revealed to work as a public affairs specialist for the government health agency headed by Dr. Anthony Fauci.

    William Crews, who has been editing and writing for the conservative site RedState under the pseudonym “streiff,” has railed against his colleagues at the National Institute of Allergy and Infectious Diseases, accusing them of being part of an anti-Trump conspiracy. He has also called Fauci, the government’s top infectious disease expert and the director of the NIAID, “attention-grubbing” and “media-whoring,” the Daily Beast reported on Monday.

    Fauci and other government health officials, such as Robert Redfield, director of the Centers for Disease Control and Prevention, have spent months urging the public to take the threat of COVID-19 seriously, take steps to mitigate the spread of the virus, and prepare for a severe flu season that will compound the danger of infection.

    Crews has also slammed public health officials at other federal agencies for their roles in imposing economic restrictions to slow the spread of the virus, which he argued had no basis in science and were part of an effort by the Left to destroy the economy and hurt President Trump’s reelection chances.

    “I think we’re at the point where it is safe to say that the entire Wuhan virus scare was nothing more or less than a massive fraud perpetrated upon the American people by ‘experts’ who were determined to fundamentally change the way the country lives and is organized and governed,” Crews wrote in a June post on RedState.

    The NIAID told the Daily Beast in a written statement that Crews will retire, adding, “We have no further comments on this as it is a personnel matter.”
