    Governor attacks Austin decision to cut police budget


    AUSTIN Since Austin City Council’s unanimous Aug. 13 decision to cut roughly $100 million out of the city’s police budget and separate an additional $50 million worth of police funding in an effort to reimagine public safety, Gov. Greg Abbott has threatened a state takeover of the Austin Police Department and has promised legislation that would make it “basically financially impossible” for cities to cut police budgets. On Sept. 10, inside the Austin Police Association’s headquarters, Abbott continued his beratement of City Council’s decision. He announced legislative plans that would remove annexing power for any city that “defunds” its police department and would off er previously annexed parts of town the option to secede from the city. Abbott previously promised legislation for the 2021 session that would prohibit cities that cut police department budgets from raising more property tax revenue.

    “Combined together, all of these proposals will make it basically ¬ financially impossible to defund law enforcement,” Abbott said. “It should leave Austin with no choice but to restore the cuts they’ve already made to law enforcement.

    Austin Mayor Steve Adler dismissed Abbott’s threats as theater, denied the assertion that Austin has defunded its police department and emphasized the city’s actions were intended to provide an improved response to 9-1-1 calls.

    “To be clear, Austin city leaders have neither defunded the police department nor support doing so. I’m unaware of any elected official who believes differently,” Adler said in a statement. “The governor’s pledge is political theater intended to scare and distract us from important public safety conversations about opening our children’s schools and saving lives during the pandemic or whether police should be mental health first responders and social workers.”

    Unless Governor Abbott gets his act together and ends the “virus” lockdown NOW, his efforts to prevent Austin and the state of Texas from becoming a San Francisco / L A hellhole will be in vain.

    I notice the for-sale prices of existing homes in the area have gone up almost exponentially very recently. Anybody who buys one of these overpriced homes when the public safety protections afforded by an adequately funded police department have been withdrawn is cognitively challenged.

    I also notice the political ads for people running for city and county elected positions deliberately do not communicate their political Party affiliation.

    Shame on Governor Greg Abbott and the Texas Department of State Health Services for accepting without thoroughly checking the data provided to them by the NIH and the CDC and other Dr. Anthony Fauchi-contaminated “scientific” data about the “pandemic virus “provided to them upon which they based draconian destroy-Texas and Texans policies.

    One has to wonder how much other GIGO data Texas governmental entities are accepting without vetting and upon which Texas governmental laws and policies and Executive Orders are promulgated.

    In response to evidence of China’s intensified spying on the United States, the State Department has retaliated by expelling China’s consulate from its Houston premises, one of five across the nation. The U.S. has also delayed returning U.S. diplomats to China. To this measured, nonviolent answer to a national-security threat, progressives like Houston-based State Rep. Gene Wu (D-137th District) are venting their outrage. When called out on social media by this webzine and others for blaming America and shilling for the Chinese government, Wu and his allies have called eviction supporters extremists, warmongers, and—as if on cue—racists. The legislator should have dropped the subject and spared himself further embarrassment.

    Because Wu is Chinese-born, it goes without saying that a suggestion that he or any member of his family has toadied to communist China should not be made lightly. Are we saying he actually welcomes the Chinese government setting up operations in Houston?

    Well, he certainly said it. As part of a delegation to China led by Houston Mayor Sylvester Turner (D) in 2017, Wu said, “I think it helps to reach out to the Chinese government to remind them that we are here, that Houston is a great place for them to set up operations. It also provided opportunities for us to understand each other’s needs,” according to the state-run China Daily. At that event in Shenzhen, Turner signed a memorandum of understanding for the building of manufacturing facilities by CIMC-TianDa, a Chinese producer of airport and seaport equipment.

    Given his past support for unchecked commercial and diplomatic relations with China, Wu would have to muster true humility to condemn its espionage and support the Trump administration’s countermove. He might, for instance, have acknowledged that China is suspected of stealing medical research, possibly germane to the development of a coronavirus vaccine. The New York Times reports that literally hundreds of investigations to this effect are underway. Instead, Wu condemned the consulate ouster itself in the most hysterical terms.

    Herewith, a sampling of his pertinent tweets Wednesday: “This is how WW3 starts….” “I said this could start a war.” “This is madness. Congress was not even informed. Rational nations don't act like this…. This is Trump trying to start an actual war to distract from his poor COVID19 performance and sinking polling numbers.” “This is insanity…. This is not how you respond to economic espionage…. This is how you start actual wars.” “Trump is going to prison… for a myriad of offenses.” Once Wu’s pro-China ravings spurred an online backlash, Houston City Councilwoman Abbie Kamin (D-District C) called the assemblyman’s opponents “wait for it… racist.” (“Wait for it” in the original, if you can believe it.)

    Wu has attempted to bolster his apologetics with the reportage of his own wife, ABC 13’s Miya Shay, herself born in China with the given name Shu Xie. The representative has uncritically tweeted her reporting on the eviction and the consulate’s subsequent burning of documents. Shay introduced her first broadcast about it on Wednesday thus: “Who would’ve thunk that initially what was seen by neighbors here on Montrose as a fire in the consulate building—which they had to call the fire department [about]—would end up being the center of a worldwide diplomatic row between the U.S. and China? The Consul General here says it’s unwarranted.” She parroted his characterization of the document incineration as “internal measures” and left his denials of espionage unchallenged. Shay summed up the practical impact of the consulate expulsion as simply detrimental to ordinary people: “The Chinese Consulate managed the visa affairs of people who want to do business in China, overseas students [in] eight states and Puerto Rico. What will happen if they close on Friday and everybody flies back to China? No one[’s] quite ready to address that yet.”

    A follow-up broadcast by Shay featured a seven-minute softball interview with Consul General Cai Wei, wherein she allowed him to portray American accusations of hacking and espionage as baseless. She once noted a New York Times report that Cai and other Chinese diplomats face scrutiny for “questionable activities” past security in the George Bush Intercontinental Airport, including escorting travelers with fabricated birth certificates. Cai responded, “We just follow the rules.”

    Shay failed to note any conflict of interest in pursuing the exclusive interview with the consul general, despite her husband having worked with Cai in the recent past. The two participated in a February press conference held by U.S. Rep. Al Green (D-9th District) concerning the response to the COVID-19 outbreak.

    The representative has been, to say the least, a celebrated associate of the Chinese diplomatic corps in Space City. At an event held by the World Financial Group on post-Hurricane Harvey reconstruction, Wu appeared alongside the consul of Yichuan of the Chinese Consulate General in Houston.

    Wu has stated in lawyerly fashion that in the past he has supposedly condemned China’s human-rights violations, deceptions regarding COVID-19, and intellectual-property theft. His snarky rejoinder to critics on those matters this week was literally this: “Don’t forget Hong Kong… Don’t forget Tibet… Don’t forget religious oppression. What else you got tough guy?” Of course, none of this recognizes that China has actually done anything. (The communist Chinese themselves have not forgotten Hong Kong or Tibet; they have usurped them. Neither Consul General Cai nor his staff returned a request for comment.) Wu doesn’t even fleetingly address spying, deception, or thievery.

    Gene Wu denies that he flacks for Chinese political interests. He should stop doing it.

    Businesses of all types are being driven out of the city of San Francisco as organized packs of thieves bring a new insurmountable challenge to retailers in the area. This is the 3rd Walgreens that has been forced to close in San Francisco due to an inability to keep the shelves stocked with so many people involved. The City has made some adjustments to the laws on shoplifting lowering the penalty and enabling a quick release from jail should they be stopped in the act. The response has been strong and immediate and the lack of reaction from the retailers themselves who admit "are afraid to be sued" for attempted to stop thieves from filling up garbage bags full of merchandise. More and more people are becoming emboldened to begin stealing because there just simply is no one willing to stop them anymore. These changes might be slow and appear insignificant at first but eventually once there are no businesses willing to keep their doors open in a uninhabitable waste city where it's too uncivilized to operate a store. This is only the beginning as well since unemployment remains strikingly high and food prices keep rising without regard so those who are the lowest income earners will be forced to turn to unsavory actions just to be able to eat.

    My Texas city has recently taken 150 million dollars away from our city Police Department. People in their homes and businesses are no longer reporting “transients” panhandling and leaving organic and non-organic debris near their front door because the police say they are not allowed to respond to these calls anymore. This gradual emptying of shelves and items missing at our drugstores and other retail stores could be partly caused by a gradual increase of shoplifting, which is likely no longer being reported by merchants.

    This means our local crime statistics are GIGO no good anymore. Shoplifting may be up and soon-to-be way up.

    Lawsuit planned over Travis County Clerk’s poll watcher ‘sequester’ during ballot counting

    AUSTIN (KXAN) – As vote counting winds down in Travis County, the Republican Party is working to have the courts hold Clerk Dana DeBeauvoir responsible for “knowingly” obstructing multiple poll watchers during the November election.

    The Republicans and Democrats are allowed to appoint poll watchers to monitor ballot tabulation and counting inside the county’s Central Counting Station. But poll watchers claim DeBeauvoir sequestered them inside of a “media room” where they’re unable to hear or see elections staffers counting ballots.

    The room has windows that looks into the counting station, but the door to the station is locked. Watchers told KXAN they’re not able to see the tabulation machines and cannot hear vote totals called out by elections officials and have no way to verify the county’s following the law in the counting process.

    The party filed a request with the Texas Supreme Court over the weekend, asking the court to force DeBeauvoir’s “compliance with the law,” the mandamus action stated.

    The filing was intended to prevent DeBeauvoir “to not sequester duly appointed poll watchers in a locked room separate and apart from the central counting station when it is open such that they cannot observe any activity conducted at that location as required by law,” Austin attorney Eric Opiela wrote in the mandamus filing.

    Texas law allows poll watchers to “observe any activity conducted at the location,” and a watcher “is entitled to sit or stand conveniently near the election officers conducting the observed activity.” The law also allows a watcher to “sit or stand near enough” to the election officer “who is announcing the votes to verify that the ballots are read correctly or to a member who is tallying the votes to verify that they are tallied correctly.”
    State requests criminal investigation into alleged election violations inside Travis County Clerk’s Office

    Both the Texas Secretary of State and the Texas Attorney General’s Office have clarified whether an elections office can sequester poll watchers.

    In March, the SOS got a complaint from Gillespie County poll watchers that Elections Administrator Anissa Herrera had built a “holding pen” for poll watchers inside the county’s counting station. Watchers were not allowed to move outside of the pen and reported to the SOS they could not see or hear the ballot counting and tabulation.
    This March 3, 2020 email from the Secretary of State reminded the

    Gillespie County Elections Administrator of a criminal penalty for obstructing poll watchers after watchers complained to the SOS about being roped off into a “holding pen” during the March 2020 primary election.

    “I was told that you all had sectioned off part of the CCS for poll watchers, and that the presiding judge is prohibiting the poll watchers from getting close enough to the equipment to observe the counting/tabulating activity,” SOS Legal Director Christina Adkins wrote in a March 3, 2020 email.

    “Poll watchers do have a right to watch these activities and prohibiting them from doing so is a criminal act,” Adkins continued.

    On Nov. 8, the attorney general filed a brief in the Travis County mandamus further explaining that sequestering poll watchers in DeBeauvoir’s “media room” would constitute a crime under the Texas Election Code.
    Texas Supreme Court declines to intervene in Travis County poll watcher alleged ‘sequestration’

    “Local election officials have a duty not to ‘knowingly prevent a watcher from observing an activity the watcher is entitled to observe,’” Texas Solicitor General Kyle Hawkins wrote in the Nov. 8 filing.

    The attorney general wrote the brief in support of the Republican Party’s effort to have the Supreme Court order DeBeauvoir to not sequester poll watchers. The court denied the petition for Writ of Mandamus with Justices Eva Guzman, Jeff Boyd, John Devine and Jimmy Blacklock dissenting.

    The order stated that Guzman “would grant temporary relief” to allow the Republican Party to take their arguments to a district court.

    “We’re doing it now,” Opiela told KXAN when reached by phone Monday morning. Opiela said he’s working to file a lawsuit in Travis County to have the court decide whether DeBeauvoir can continue sequestering poll watchers.
    Clerk Defends ‘Media Room’

    Travis County Clerk Dana DeBeauvoir did not respond to a request for comment for this report. DeBeauvoir did agree to an interview on Nov. 2 where she defended the use of the “media room” to house poll watchers, keeping them away from her elections staffers.

    “We have a whole room that’s been specifically built in the middle of our counting station. It’s got double doors on one side and windows on the other two sides of the doors so that they can, poll watchers can watch the electronic part of the processing and tallying and also the scanning part which beats the paper trails and by mail ballots through scanners,” DeBeauvoir told KXAN investigator Jody Barr.

    “It’s a premier spot, it’s an excellent facility for the poll watchers, probably the best in the whole state,” DeBeauvoir said.

    Last weekend’s mandamus filing in the Supreme Court contained affidavits from three separate poll watchers, each claiming they could not hear or see what they needed to see inside the counting station in order to perform their legislatively-approved services.

    Travis County Clerk Dana DeBeauvoir called the “media room” she built a “premier facility” for poll watchers in Texas. That media room is the subject of what the TX Secretary of State wants the Texas Attorney General’s Office to open a criminal investigation into.

    “As a Poll Watcher, I did not have sufficient access to verify the integrity of the process,” Susanna L. Gallun wrote in her affidavit.

    As a poll watcher, I am especially concerned about the right hand corner of the room in the back and the PC screens we could not see. I do not understand why the vendors are feeding ballots into the machine and handling ballots. I do not understand why poll watchers are physically separated from the area of the tabulation machines and PCs that adjudicate ballots. I am concerned that the sound is also not good enough for poll watchers to really hear conversations in the room. We had limited access to the opening of several ballot box seals as well due to the desks and PC’s blocking our view of the room,” Gallun continued.

    In the Nov. 2 interview, DeBeauvoir also scoffed at allegations from poll watchers about being unable to hear conversations from the other side of the glass. The clerk said she had a PA system “piped into” the media room so poll watchers could hear conversations inside the counting station.

    One poll watcher said the clerk’s office was using a speaker on a cell phone application to allow poll watchers to hear what was being said inside the counting station. That watcher also alleged there was no sound being broadcast from inside the central counting station for “two to three hours” the morning of Nov. 2.

    “I was unable to enter the room, see the displays on the ballot counting machines, or hear conversations between workers in the room. There was a microphone and speaker set up, but conversations were drowned out by machine noise,” Gary McMillian wrote in his affidavit.

    DeBeauvoir told KXAN she decided to build the media room in response to a January 2019 Supreme Court order which addressed complaints related to poll watcher obstruction inside the Travis County Clerk’s Office dating back to 2014.

    “That’s when we built the room and designed it the way it is today, it was in response to those requests or the additional ability to see what was going on. That’s why the room is built the way it is today,” DeBeauvoir told KXAN on Nov. 2.

    “Are these poll watchers able to see all around, everywhere a ballot may be handled, the tabulation may be under way, they may be able to see this and listen to what’s going on with that,” Barr asked DeBeauvoir in the Nov. 2 interview, “Yes, everything from when they’re brought in, checked off the list, you can see the information on the wall that says what’s come in, what hasn’t. The part where it’s opened up, the part where it’s run through the scanners and then the part it’s air gapped, the second part where it’s run through the accumulators and the results are produced. They can see that entire process,” DeBeauvoir said.

    The Republican Party’s lawsuit was not filed at the time of this report.

    A 38-day standoff in Texas over a GOP-backed election reform bill came to an end on Thursday when some House Democrats, who fled the state, returned—a day after it was ruled that they can be arrested if they refuse to return to the state Capitol to conduct legislative business.

    The return of Democratic state Reps. Garnet Coleman, Ana Hernandez, and Amanda Walle paves the way for Republicans to resume work on voting overhaul bills that they argue are needed to safeguard future elections and would restore the public’s confidence in them.

    Last month, 52 state House Democrats broke quorum when they absented themselves from legislative business in order to block the measure and others like it. Democrats have argued that the GOP-backed election reform bill would place unfair restrictions on minority groups when they cast their ballots.

    While only three Democrats returned to the Lone Star state, Republican House Speaker Dade Phelan said enough were there to achieve a quorum, which in the House is normally 100 present legislators.

    While Republicans control both legislative chambers in Texas, as well as the governor’s mansion, two-thirds of lawmakers must be present to constitute a quorum. Republicans only hold 82 seats in the 150-seat lower chamber.

    “It’s been a very long summer. Been through a lot. I appreciate you all being here,” Phelan said. “It’s time to get back to the business of the people of Texas.”

    The three Democrats who returned to the Texas House from Washington D.C. issued a joint statement on Thursday defending their decision to leave last month.

    “We are proud of the heroic work and commitment we and our fellow Democratic caucus members have shown in breaking quorum in May and again over this summer,” they said. “We took the fight for voting rights to Washington D.C. and brought national attention to the partisan push in our state to weaken ballot access.”

    The lawmakers added: “Our efforts were successful and served as the primary catalyst to push Congress to take action on voter protection legislation. Now, we continue the fight on the House Floor.”

    Their return came a day after the Texas Supreme Court ruled that the state’s House Democrats can be arrested if they refuse to return to the state Capitol to conduct legislative business.

    The opinion (pdf) orders district courts to rescind their temporary restraining orders handed to state Democrats who have broken quorum since last month.

    House members can be compelled by leaders to be present to conduct legislative business under the state Constitution, and those who refuse can be arrested and brought to the chamber, the ruling stipulates.

    Previously, Texas Gov. Greg Abbott, a Republican, threatened that Democrats who broke quorum to prevent the start of the special legislative session would be arrested.

    Abbott’s office didn’t immediately respond to a request by The Epoch Times for comment.

    Republicans are now back on a path to pass new elections laws in Texas before the current special session ends on Sept. 5.
