    The letter followed a 6-3 decision by the Supreme Court last week, which halted President Joe Biden’s OSHA vaccine mandate for businesses with 100-plus employees while the mandate is being challenged in the Sixth Circuit.

    OSHA has not withdrawn its emergency temporary standard (ETS) following the Supreme Court’s ruling. In the letter, the attorneys general “described the detrimental effect that the OSHA mandate will have on employers and businesses if it goes into effect.”

    Dear Assistant Secretary Parker: 27 State Attorneys General Ask OSHA to Withdraw Coronavirus Vaccine Mandate

    The undersigned States submit the following comments on the COVID-19 Vaccination and Testing; Emergency Temporary Standard issued in 86 Fed. Reg. 61402 (Nov. 5, 2021) (“ETS”). The States have already filed a Petition to Review the ETS, which is pending at the U.S. Court of Appeals for the Sixth Circuit (In re MCP No. 165), and the United States Supreme Court granted an emergency application for stay of the ETS on January 14, 2022 (Nat’l Fed’n of Indep. Bus. v. OSHA, 595 U.S. ___ (2022)).

    However, despite that the United States Supreme Court─in a 6─3 decision─has held that the Occupational Safety and Health Administration (OSHA) lacks the statutory authority to issue the type of rule reflected by the ETS, OSHA has yet to withdraw the ETS. We therefore submit these comments to reiterate that OSHA lacks authority to require that tens of millions of employees vaccinate against an endemic virus that presents a generic risk, not a workplace risk. OSHA should, therefore, immediately withdraw the ETS and suspend its efforts to promulgate a similar permanent standard.

    Good news! Sort of.
    Although no longer an enforceable act, the legislation still exists in attenuated form to persuade companies to clot-shot their employees.

    SUMMARY:
    OSHA is withdrawing the November 5, 2021, emergency temporary standard (ETS) which was issued to protect unvaccinated employees of large employers (100 or more employees) from the risk of contracting COVID-19 by strongly encouraging vaccination.

    DATES:
    The withdrawal is effective January 26, 2022...

    Although OSHA is withdrawing the Vaccination and Testing ETS as an enforceable emergency temporary standard, OSHA is not withdrawing the ETS to the extent that it serves as a proposed rule under section 6(c)(3) of the Act, and this action does not affect the ETS's status as a proposal under section 6(b) of the Act or otherwise affect the status of the notice-and-comment rulemaking commenced by the Vaccination and Testing ETS. See 29 U.S.C. 655(c)(3).

    Notwithstanding the withdrawal of the Vaccination and Testing ETS, OSHA continues to strongly encourage the vaccination of workers against the continuing dangers posed by COVID-19 in the workplace.

    Sens. Joe Manchin (D-WV) and Jon Tester (D-MT) voted in December for a Congressional Review Act (CRA) resolution to defund the private employer vaccine mandate.

    Manchin and Tester voted no on Lees amendment.

    The Supreme Court has blocked the Occupational Safety and Health Administration vaccine mandate for large employers; however, the federal government can still enforce the other four mandates, which include the mandates on medical workers, military personnel, federal employees, and federal contractors.

    Lee and Sens. Roger Marshall (R-KS), Cynthia Lummis (R-WY), Mike Braun (R-IN), Rand Paul (R-KY), and Ted Cruz (R-TX) have led the fight to defund Bidens vaccine mandates.

    The administration argued that the Constitution gives the president, as the head of the federal workforce, the same authority as the CEO of a private corporation to require that employees be vaccinated.

    Lawyers for those challenging the mandate had pointed to a recent Supreme Court opinion that the government cannot force private employers to require employee vaccinations.
    What's next, orchidectomies required for all public servants?

    After all there is precedence of such treatment for servants. Would improve workplace safety for women, reduce male privilege, reduce medical costs associated with prostrate problems.
