    The highest uncontested law of the land in America is the Constitution for the united States of America. I would like to share with you some phrases and passages from three parts of the Constitution and one passage from the Bill of Rights which is permanently attached to the main body of the Constitution.

    Militia Clauses
    Article I, Section 8, Clauses 15 & 16:
    [The Congress shall have Power To…]


    Clause 15
    : [ ] “To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions;”

    Clause 16
    : [ ] “To provide for organizing, arming, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States, reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress;”


    Article II, Section 2, Clause 1:

    “The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States…”

    The disappearance
    of our State Militia, due in large part to “The Efficiency in Militia Act of 1903“, also known as the Dick Act, is something we the people may change. We can reinstate the Militia system into our daily routines and re-establish the State Militia office in each State in the Union. That is not only possible, it is required by our Constitution. It does, however, appear that most Americans are not informed about this opportunity, this duty, to regain control over our berserk national government.

    The lawfully required Militia of the several States would instantly evaporate the need for any Hitlerian-styled Big Brotheresque “Department of Homeland Security”, and at the same time would largely eradicate the burgeoning police state in our communities.     In my most confident understanding of the need, duty, and pleasure in reinstating the Militia of the several States, I, Elias Alias, owner of The Mental Militia LLC, have realized that before we will ever see the return of our rightful Militia out here in reality across our lands, in every “Sovereign Nation-State Republic” in the Union, is to first create, or, rather, “re-create” in the group mind the concept of a Militia.

    That concept must be a mental vision, and it must be harmonious with each individual’s desire for personal freedom and the responsibility from which such freedom springs naturally. In other words, the concept must be born first in our minds as an idea; as a “mental image”. That is one of the objectives of this website. I am calling for the necessary State level legislation in every State to create the State Militia office so that rosters of volunteers can begin and the organizational structure of our long-lost Militia can finally be returned to We The People. I am hopeful that many reading here will begin to envision in their individual minds the mental imagery of a culture-based society which assumed responsibility for itself and broke the addictive reliance on the Federal government to manage our affairs in our own States.

    While the States have let this part of our heritage decompose in a river of apathy, yet even today many Americans are taking renewed interest in the Militia system and are forming un-official Militia in their respective areas. That sort of organizational activity is not incompatible with the Constitutional requirement of State governments’ Militia, and can co-exist. I, for one, am glad to see all Militiamen and Militia-women standing even now without State or Federal support. I truly hope this website helps your Militia develop and grow in ways you’ll enjoy and find to be beneficial to your goals.

    Your "goofy weekend warrior" neighbors can form legitimate "Independent Companies" explained here. They just need to exchange the camo for suits, put down the beer and proceed through proper channels:

    INDEPENDENT MILITIA COMPANIES

    “[T]he States reserve to themselves the power to form Independent Companies, no matter what Congress may want. Congress can observe Independent Companies’ right to exist, but not obstruct its exercise.     Independent Militia Companies

    Contrary to popular belief circulating among many patriots today, constitutional Militia are not formed by a well-intentioned group of people in possession guns calling themselves “militia”.

    As a matter of historical fact and law, “well regulated Militia” were governmental institutions organized pursuant to statute, not private associations. The Independent Militia Company was established by relatively small groups (approximately 20-100) of people through the legislature, which gave them legal authority—something a private group calling themselves “militia” has never, can never, and will never accomplish.


    Independent Companies were not merely ceremonial or honorary outfits. They were usually formed by those who desired more specialized training and discipline not acquired in standard Militia service. And to a great degree organized, armed, disciplined, and trained themselves separate from the Militia’s regular establishment. (footnote 1)

    Rhode Island for example, permitted, encouraged, and provided a procedure for her residents to organize “Independent Companies” as separate components of her Militia. As with the Trained Bands, Independent Companies could consist of infantry, (footnote 2)
    cavalry, (footnote 3)
    and even artillery. (footnote 4) (footnote p. 103)

    While Militia service was compulsory for every able-bodied adult, members of Independent Companies would receive exemptions from their standard Militia service since they voluntarily chose to form a more specialized Independent Militia Company upon the approval of the legislature.



    It is important to note—Militia service in the pre-constitutional period was required by law of every able-bodied adult free male between 16-65 years of age in the American Colonies. Independent Militia Companies, were a voluntary forms of Militia service, like the Minutemen. So while serving in a well regulated militia was compulsory, individuals forming an Independent Company was voluntary. To establish an Independent Militia Company required the approval of the legislature. All members of any Independent Company were required to conform to the standards of their own charter. Failure to do so would result in the revocation of the charter, returning those members back to standard Militia service.

    In contradistinction to contemporary times, in pre-constitutional Rhode Island citizens who sought to form Independent Companies were considered praiseworthy, not suspicious, let alone possibly subject to prosecution for supposedly criminal acts. (footnote 5)

    Organizing Militias as the centerpiece of the “Homeland Security” structure would take maximum advantage of local people and would leave the maximum amount of governmental control in the hands of those people. The Independent Militia Company, as a matter of fact and law, would be the most efficient and direct means for local people to revitalize the constitutional Militia.

    The initial step, to organize, educate, and empower citizens to properly make that transition is the CHSACitizen’s Homeland Security Association.

    Citizens’ Homeland Security Associations (CHSA)- The key to revitalizing “the Militia of the several States”.

    Befitting a project that is not optional, the ultimate step for revitalizing “the Militia of the several States” within and under the aegis of each of “the several States” must be legislation: the enactment of comprehensive sets of State statutes, (footnote 1)

    possibly with a capstone of Congressional legislation to provide any necessary uniformity in “organizing, arming, * * * disciplining, * * * and * * * governing” the Militia that individual States may have overlooked or set at cross purposes. (footnote 2)

    Before this step is reached, however, two others must be taken:


    CHSAs must begin their operations while the intellectual foundation for revitalization of the Militia is still being completed, because their operations will contribute significantly to that foundation. Although History can describe how the Militia were organized and operated in the past, only close study of and careful experimentation under present-day conditions can prescribe how the Militia should be organized and operate in the context of today’s needs and resources.     The ultimate goal of the Citizens’ Homeland Security Association is to transition into a permanent constitutional Militia Structure in that State. CHSA’s are not “militia” in any constitutional sense, but private associations.
