According to the report (given by the FBI) the gun was found in his pocket - so they never saw him brandishing a firearm. If he wanted to go down shooting, he would have made sure to at least draw the gun when he had the opportunity

You forgot about him speeding away from a traffic stop...crashing into the roadblock with a woman in the vehicle ..after publicly declaring that he would not be taken alive.
Would you have done that or would you have peacefully surrendered and LIVE like the other guy five minutes before.

Saying and doing are two different things. Does that justify every person who runs from the cops getting executed? What's the point of a judicial system if the cops are judge, jury and executioner right on the spot of your arrest?
At the most I saw was fleeing police, and resisting arrest. I did not see him charge an officer, and I also did not see him brandishing a weapon. If LaVoy had pulled out his hand gun I would of agreed the cops were in the right to shoot.
You have to remember, it would not of mattered if LaVoy pulled his gun as the cops already had their weapons trained on him with their fingers on the trigger. So the amount of time it would of taken for LaVoy to reach into his pocket, pull out his gun and start aiming at officers he already of would of had every one there shooting at him. THAT would be suicide by cop.
What that video was and still is, murder by the state.

I am believing my own eyes, I've probably spent 2 hours going through that video with a fine toothed comb zooming in as far as I can before pixelation renders the image / frame useless. I'm just going by what I see in the video. It looks like he got shot in the side and he's putting his hand on the wound.
Like I said I'll wait until I see the autopsy report to see if there is a bullet wound or not. If not I'll concede that it was not a very smart move to put his hands towards his pocket while police have their weapons trained on him.

We do not have enough evidence to know exactly what happened. True, he sped away from the cops, but running from cops itself is not a crime. He did swerve to avoid the roadblock, which is reckless driving, but not something justifying shooting. The real issue is what was going on as LaVoy was reaching to his jacket? What did the sniper coming out of the trees see, and what could he justifiably say he thought. The FBI and Oregon cops did set a trap, and knew they would be forcing them into a road block, so they do are responsible for the outcome. What a mess.
