You are mis-informed. They do not own the land nor do they claim to. Nor is it Public land Bardon v. Northern Pacific Rail Road.

The Bundy family has owned grazing rights, not BLM permits since the late 1800,s. These rights are private property under Nevada law. The Congress created the Bureau of Land Management in 1946 and gave them power to write their own rules and regulation under the Administrative Procedures Act of 1946. The Bundy family, like most ranchers signed a contract with the newly minted BLM to pay for managment costs. All the Acts of Congress relating to the BLM say they wiil respect all prior rights, water, mineral, grazing, etc that have been appropriated to the people. The BLM ignored the Congress in the writing of their regulations. In 1993 the regulations were becoming so stringent Cliven Bundy canceled his contract with the BLM. Without a contract they cannot accept payment. Bundy offered the money to Clark County, Nevada who refused it. He put it on deposit in the bank.

The original grazing and water rights recognized by Congress and by Nevada are still intact. He still owns the right to the feed and the water. He also owns the improvements to the springs and fences. The only thing he has done is refuse to contract with the Bureau of Land Management who is required by law to respect his rights.

The jurisdiction of the US District Court and the attorneys is doubtful. Newcomers who do not have vested grazing rights may enter into a contract for a grazing permit. But the must own a base property and water rights. A grazing permit may be revoked. Rights cannot.

Sounds to me that Bundy wanted grazing rights for nothing if he thought his grazing rights continued after canceling the contract.

Title to the rocks and the mineral remains with the United States until sold or other wise transfered by Congress, and only Congress. By contract they own the rights, not because you have cattle on the land and have been living on the land due to the contract.

Rights to forage and water are not rights in the same as God given rights.
If I lease a car (contract) I have the "right" to drive it, but if I cancel the lease I do not have the "right" any longer to drive it.
Bundy lost all rights to forage and water when he nullified the contract. If I remember correctly the BLM asked him to get off the land and when he refused they shot some of his cattle as they were trespassing as he no longer had a contract to graze.
He shot himself in the foot by doing so.

Every Act of Congress from the Taylor Grazing Act to the most recent Act of 1976 that closed all the homestead laws specifically state all prior rights, mining, logging, grazing, or whatever are to be honored and preserved. The Bureau of Land Management has not followed the Statutes when they wrote these regulations.

Livestock Grazing on Federal Lands

Contraire to popular belief by the uninformed, no act, including FLPMA and ESA has extinguished existing Livestock Grazing rights or make any superior to them.

In other words, "existing rights," including Forage and Water put to beneficial use by Allotment Owners, constitutes their ownership of - i.e. becomes "Property" of Allotment Owners.

Nothing, including the Taylor Grazing Act and Wild Horse and Burro Act, has extinguished those rights or bumped any critter - including Sage Grouse, Feral Horses etc., into "Preference."

Therefore, Allotment Owners do not have to strive for "Preference" position, as no act has ever denied them that historic position.

This knowledge will adjust your thinking, in that it will rightfully place any "after acts and critters" into low secondary positions, and leave Livestock Grazing in Preference.

Congress has protected the rights granted by the United States to allotment owners, miners, loggers and others. They have given the BLM power to regulate grazing, but not power to take away existing rights.

Past presidents, including Clinton, Bush and Obama have packed the federal courts with communist judges like Jdge Anna J. Brown and Judge Gloria Navarro who will not abide by the Constitution or allow it in their courtrooms. During the Clinton administration Bruce Babbit implimented his biodiversity Agenda 21 programs. Groups like Kierán Suckling's Center for Biological Diversity take federal grant money, sue the Bureau of Land Management, the corrupt judges rule in favor of the bio diversity groips, forcing the BLM to violate the law. This creates an impossible hardship on the cattleman. He is forced to sell or face bankruptcy. Cliven Bundy chose to cancel his contract rather than sell to Kierán Suckling's Center for Biologiclal Diversity which would be promoting the United Nations communist NWO Agenda 21. The Bundy's have taken a stand to fight against communism and to defend the Constitution against crooked politicians, a corrupt court system and the Satanic Agenda 21 promoters.
